Sales Agreement / Conditions of Sale:

This Agreement supersedes any prior written or oral agreements between the parties, and the Purchaser is not relying on any prior representations when entering this Agreement.

  • All merchandise sold by Power Tool Pallet Liquidation is liquidation, salvage, store returns, or used merchandise and is sold AS IS, with no warranties or guarantees of any kind, expressed or implied, including but not limited to merchantability and fitness for a particular purpose.
  • All merchandise is sold in AS IS condition, and no refunds, returns, credits, cancellations, or exchanges will be offered or honored. Merchandise may be ripped, stained, damaged, or defective.
  • Neither any listed department stores nor Power Tool Pallet Liquidation will be held liable for dissatisfaction regarding the sale or quality of merchandise, including any shortages in quantity.
  • Lots may be sold as bulk lots without a specified wholesale value, percentage, or piece count. The stated value or quantity of any lot is merely an estimate provided to Power Tool Pallet Liquidation by its suppliers and does not represent or guarantee the actual wholesale or retail value or the exact quantity included in the lot.
  • All sample lot pictures are for illustrative purposes only and are not representative of the entire shipment to the customer.
  • If a purchaser refuses to accept a lot or any portion thereof, the purchaser assumes responsibility for all associated shipping, storage, and redelivery costs. Freight carriers may confiscate the refused lot to recover incurred expenses. Power Tool Pallet Liquidation shall not be liable for any costs or losses related to a refused lot.
  • Power Tool Pallet Liquidation is not liable for any loss of profit, financial or economic loss, or indirect or consequential damages arising from the purchase of merchandise. This includes but is not limited to indemnity claims, contract breaches, statutory duty violations, or negligence.
  • By completing the purchase, the customer acknowledges that they have inspected the merchandise and agree it is as described. The purchaser also agrees that Power Tool Pallet Liquidation has provided all merchandise as stated in the terms of sale, invoice, and bill of lading.
  • The purchaser agrees to be fully responsible for all credit card or other payment charges incurred for the merchandise and will not dispute or charge back a credit card purchase for any reason.
  • Buyers are prohibited from using the names of specific department stores in their advertising.
  • Freight is arranged as a courtesy, and freight quotes provided are only estimates. Pallet counts and lot weights are approximate when communicated to shipping companies or the purchaser. Any additional charges for overages, detentions, or layovers are the purchaser’s responsibility and will be billed accordingly.
  • The laws of the state of Houston will govern any disputes or issues arising from this sale. Any arbitration related to this purchase will be at the sole discretion of Power Tool Pallet Liquidation. A restocking fee of 20% may apply to returned items involved in arbitration.
  • These conditions of sale are considered accepted upon payment, shipment, and delivery of the goods.
